  1. Acceptance of Terms. Internet Marketing for Training Providers (hereafter known as “IMTP” or “I'MTP”) is an online Digital Marketing service provided by OTK Web Solutions® (hereafter known as “OTK”, “we”, or “us”) to all qualified training providers in Malaysia (hereafter known as “members”, “users”, or “subscribers”) based on the business rules and requirements defined by OTK. By using this service, you agree to be bound by these Terms and Conditions of Service, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws. If you do not agree with any of these terms, you are prohibited from using or accessing this service. The materials contained in this web site are protected by applicable copyright and trade mark law. OTK will not responsible for any contents published on the Internet submitted by the subscribers. However, OTK reserves the rights to reject and disapprove any contents submitted by the subscribers, including but not limited to pornographic, gambling, spamming, and illegal contents that violate both the local and international law.

  2. Other Service Terms & Policies. The following service terms and service policies are described on their respective context printed on MalaysiaTraining.net:

    By submitting your I'MTP Membership Application Form to OTK, you agree to all terms and policies listed above. All affected members will be informed of any change on the above service terms and/or policies and will be given the rights to accept the change by continue the use of the service or not to accept the change by discontinue the use the service. Any breach of the above service terms & conditions, service policies, and application requirements will lead to termination of your I'MTP Membership Account and will be banned from your future application or subscription to any of our services.

  3. Subscription Plans. I'MTP Subscription Plan (hereafter known as “subscription plan”, “service plan” or “service package”) may be revised and changed from time to time for the following reasons:

    • To improve the service quality of I'MTP to its subscribers.
    • To improve the sustainability and profitability of all parties.
    • To resolve any unfair or inappropriate implementation to either OTK or the majority of its subscribers in general but not biased to any individual preferences or prejudice.
    • To fix any vulnerabilities that could be abused, misused, and/or exploited for unintended written purpose, whether intentionally or unintentionally.

    All members will be informed of any change of I'MTP Subscription Plan and their account will be automatically upgraded to the new service terms in the event of the change. If you do not agree with the change, you deserve the rights to discontinue your subscription. The latest version of I'MTP Subscription Plans will always be accordance to the version presented on MalaysiaTraining.net website at all time.

  4. Membership Application Acceptance. All I'MTP membership application submissions are subject to approval by the management of OTK Web Solutions. Only short-listed candidates will be contacted for further evaluation and consideration. Upon membership application acceptance, an I'MTP Membership Application Approval Letter (hereafter also known as “offer letter” or “letter of offer”) will be sent to the applicant, which may contain other additional terms and agreement agreed by both parties, namely OTK and the applicant, during the evaluation process. Applicants will be given the rights to accept the offer and other terms & conditions (if any) by making the required first-time start-up payment to OTK. If the applicants do not agree with the statements stated in the I'MTP Membership Application Approval Letter, the applicants can choose to ignore the offer by not making any payment to OTK. Upon payment received, an official receipt will be sent to the applicants and the user login account to I'MTP Service Centre will be created within THREE (3) business days.

    By subscribing to any service plan of I'MTP, subscribers agreed to the terms and conditions of I'MTP. Any late disagreement on any items stated in the terms & conditions may cause the membership to be disqualified with immediate effect and any refundable monetary value will be refunded. OTK reserves the rights to disqualify any members for whichever reason by offering a prescriptive refund to the subscribers (see 5.7 - Refund and 11.2 - Account Termination).

  5. Payments. All payments can only be considered “paid” when the bank clearance is completed (hereafter known as “payment” or “payment made”). Payment receipt will only be generated and issued to the member upon bank clearance. The bank clearance must be taken place BEFORE the account suspension or termination due date, otherwise the required action will still be executed accordingly with no further exception and negotiation. All members shall responsible for their I'MTP account to prevent any unwanted operational failure, dispute, and misunderstanding.

    1. Payment Model. I’MTP is adopting Prepaid Payment Model, namely “pay first, use and/or consume later” approach, no credit terms are allowed. However, due to the unique nature of I’MTP service model, credit limit is allowed to prevent member’s account from being suspended in case of unforeseen circumstances in which the member is unable to make the top-up payment on time (see 5.2 - Deposit & Credit Limit). Any attempt by any members, through any neglected or unforeseen vulnerabilities of I’MTP Payment Terms, to misuse the said prepaid payment model as “post-paid” model, whether intentionally or unintentionally, will be considered as violation of I’MTP Payment Terms, which may lead to the termination of member’s account.

    2. Deposit & Credit Limit. Members are required to pay for the minimum amount of RM300.00 deposit in order to act as credit limit in the event when they're unable to make their top-up payment prior to RM0.00 credit balance. The credit limit, which is equal to the amount of deposit paid by the member, cannot be used and/or treated as the credit balance, neither it can be used as partial or full settlement of outstanding credit balance unless otherwise given by the member with a written prior notice for the purpose of terminating the account without the refund of deposit. OTK Web Solutions deserve the rights to qualify the said behaviour as the abuse and/or illegal exploitation of credit limit as credit balance, of which it is not being used as its intended purpose, that is to act as the 'Safety Margin' that prevents member's account from being suspended in case necessary top-up payment cannot be made on time prior to RM0.00 balance. Such behavior, whether intentionally or unintentionally, directly or indirectly, has the effect of turning the I’MTP Prepaid Model into “Post-Paid” Model, which is a serious violation to I’MTP Payment Terms. As such, OTK Web Solutions also deserves the rights to terminate any member's account who attempt to misuse, abuse and/or exploit the credit limit as credit balance with 24-hour notice.

      Members can increase their credit limit by adding value to the deposit through extra payment. The total value of deposit available in member’s account will be the total available credit limit of the member.

      The credit limit will start to be utilized by the daily traffic usage when a member is unable to make his/her top-up payment prior to RM0.00 credit balance. When the credit limit has been fully utilized, the member's account will be suspended if no appropriate payment has been made prior to the account suspension due date.

    3. Top-up Payment. The prepaid top-up payment amount must be made according to the minimum top-up value as stated in the I'MTP Minimum Top-up Payment Policy printed on MalaysiaTraining.net. First time prepaid top-up payment shall be made by the new member upon membership application acceptance. Every top-up payment made will be added to member’s account as credit balance. Every unique pageview made by site visitors to the member’s course content page or company profile will have usage cost deducted from the credit balance. The usage cost is the cost per unique Pageview as stated in I’MTP Pricing Deduction Policy. An e-mail notification will be sent to the member upon low credit balance. Top-up payments cannot be used as full or partial settlement for outstanding balance (see 5.4 - Outstanding Balance Settlement). Members are allowed to pay just the prescribed Minimum Top-up Payment Value as long as their credit balance is still greater than RM0.00. Members are also allowed to make their top-up payment greater than the prescribed minimum top-up value to avoid having to top-up too often. Late payment may lead to member's account suspension and/or termination as stated in Section 11, Account Suspension & Termination.

    4. Outstanding Balance Settlement. When member's account has reached, or fallen below, RM0.00 credit balance, all pending service requests will be on-hold until full payment settlement has been made. Any submission-date-sensitive service requests may be affected by late payment settlement, which may lead to cancellation due to certain day and time restriction.

      Members are required to fully settle the outstanding balance before they're allowed to perform their top-payment. Members who have outstanding balance are required to pay for the following full settlement:

      Total Outstanding Balance + Minimum Top-up Payment Amount (+ RM50.00 Processing Fee if account has been suspended)

      The outstanding balance must be paid according to the amount stated in the latest Account Suspension Alert sent by I'MTP Support every THREE (3) days.

      Payment made with insufficient fund to cover full settlement will be on-hold until one of the following outcomes:

      • An appropriate replenishment has been made on time for full settlement (Total Outstanding Balance + Minimum Top-up Payment Amount) before the account suspension due date, i.e. before the available credit limit has been fully utilized.
      • An appropriate replenishment has been made on time for full settlement (Total Outstanding Balance + Minimum Top-up Payment Amount + RM50 Processing Fee) before the account termination due date, i.e. SEVEN (7) days after the account suspension date.
      • A written notice of account termination request has been sent to OTK Support, together with complete bank account information, for any available refund to be made (see 5.7 - Refund).
    5. Acceptable Payment Modes. Members are only allowed to make their payments through the following methods:

      • Direct Cheque Deposit
      • Direct Cash Deposit
      • Online Fund Transfer

      The following sections describe each of the above acceptable payment modes in details.

      1. Direct Cheque Deposit Payment. For cheque payment, a complete payment advice with the following information is required:

        • Banker's Name
        • Cheque Number (required to be retyped in payment advice for clarity)
        • Payment Amount
        • Payment Date
        • Scanned copy of bank-in slip

        If no payment advice with cheque number has been received within THREE (3) business days after the bank clearance, a payment receipt without the cheque number printed as reference number will be issued. Any request for regeneration of receipt after the first issuance will cost the requestor another RM5.00 penalty, which will be deducted from the requestor's I'MTP account balance.

      2. Direct Cash Deposit Payment. For cash payment, a complete payment advice with the following information is required:

        • Payment Amount
        • Payment Date
        • Scanned copy of bank-in slip
      3. Online Banking Fund Transfer Payment. For online fund transfer, a complete payment advice with the following information is required:

        • A genuine online fund transfer receipt in PDF file format generated from the online banking's website.
    6. Issuance of Receipt & Invoice

      1. Receipt. Payment receipt will only be issued when:
        • The member has sent to I'MTP Support a properly written payment advice with the information as described in Section 5.5, Acceptable Payment Modes.
        • The bank clearance has been fully completed and payment has been successfully deposited into OTK Web Solutions' bank account.

        If no clearly written cheque number or document reference number has been given, a receipt without reference number will be issued in THREE (3) business days after the bank clearance. Any re-issuance request made by the member due to late provision of cheque number or document reference number will be charged for RM5.00 processing fee. The said RM5.00 processing fee will be deducted from member’s account credit balance upon the re-issuance of payment receipt with reference number.

      2. Invoice. Invoice will only be issued when member’s account has been terminated with outstanding balance. Only FOURTEEN (14) days payment terms will be given. Legal action may be taken to against those members who fail to settle their outstanding balance based on the given invoice and they shall responsible for all the costs spent for such legal action.
    7. Refund. In general, any available refund will be paid to member who has sent to I’MTP Support a properly written account termination request that includes the following banking information:

      • Banker's Name
      • Bank Account Name (For I'MTP corporate account, the bank account name must be the company name that identical to the I'MTP account name printed on the I'MTP Monthly Usage & Performance Report.)
      • Bank Account Number

      Once the above information is received, the qualified refund will be paid to the member according to the given banking information through online fund transfer in THREE (3) business days, which do not include the number of days required by the bank to make the clearance. OTK Web Solutions will not responsible for any disputes and/or losses that caused by any false, invalid, and/or inappropriate bank account information given by the member. The qualified refund will be forfeited without notice if the member failed to provide a complete banking information as stated above in NINTY (90) days after the first written request by OTK.

      1. Refund of Deposit. The refund of deposit is only applicable to members who had made the upfront deposit during membership application acceptance or members who have upgraded their account to credit-limit-based by paying a minimum of RM300.00 deposit as credit limit. The refund of deposit depends on the member's account outstanding balance upon account termination:

        Refund of Deposit = Total Deposit - Total Outstanding Balance

      2. Refund of Credit Balance. The refund of remaining credit balance is only applicable to members who have officially sent to I’MTP Support a 24-hour account termination request while their account still contains positive credit balance that can last for more than the 24-hour traffic usage. The said positive credit balance will be deducted by any credit bonus rewarded by OTK in the past THIRTY (30) days when calculating the available refund. All credit bonuses rewarded by OTK Web Solutions to the I’MTP members cannot be used as part of the refund or converted into monetary value.

  6. Online Application Access. All subscribers are required to have a Google Gmail account in order to login to I'MTP Service Centre that hosted on Google Blogger platform. If your Gmail account is deleted, suspended, or terminated, your I'MTP account will no longer be accessible. Valid subscribers are authorized to access to I'MTP Service Centre according to the table shown below:

    As the applications mentioned above are made up of several third party components, including but not limited to Google® Blogger, Facebook and JotForm, OTK will not responsible for any access and/or functional failure caused by the said components.

  7. Information Submission & Publishing. The term “profile” refers to “company profile” for Corporate Subscription Plan subscribers. The term “course proposal” may also refer to “course outline”, “course content”, “course attributes” or any combination of these. Information submitted by subscribers will be subject to OTK approval. Any submitted requests for account settings, profile, or course content will be notified upon rejection, approval or accomplishment. Subscribers are also required to follow the rules set by different forms for different functionality and purpose. If there are conflicts of terms and conditions between the ones stated on the application screen and the general I'MTP Terms and Conditions, the ones stated on the application screen will take precedence.

  8. Monthly Report. Previous month's Pages Performance and Usage Report will be sent to full account members at every beginning of the next calendar month. Full account members shall base on the said report to decide when to make their next top-up payment and how much they should pay of which the payment amount must not less than the minimum top-value as stated in the I'MTP Minimum Top-up Payment Policy. The usage measurement by pageview and unique pageview will be derived from Google™ Analytics report of the month. OTK will not responsible for the accuracy of the pageview figures generated by Google™ Analytics.

  9. Change of Subscription Plan. I'MTP Subscription Plan cannot be changed until the account balance reaches RM0.00 balance and an early written notice prior to RM0.00 account balance must be sent to OTK for change of subscription plan. After receiving the notice, subscribers can then apply for another subscription plan of their choice. A maximum of TEN (10) business days is required for the re-configuration of member's account and pages published on MalaysiaTraining.net

  10. Change of Account Ownership. Subscriber account ownership cannot be changed to other person or business entity (unless otherwise permitted by OTK management), neither it can be transferred to any other party. However, Corporate Plan's account owner can appoint different secondary administrator to manage his/her I'MTP account, profile, and course content.

  11. Account Suspension & Termination

    1. Account Suspension. The following describes the scenarios and conditions that will cause an account suspension and its respective effects:
      1. Conditions for Account Suspension

        • Members with Credit Limit

          Member's account will be suspended when the available credit limit has been fully utilized.

        • Members without Credit Limit

          Member's account will be suspended upon RM0.00 or negative credit balance.

      2. Effects of Account Suspension

        • All course content pages and company profile of the member will be unpublished and no longer be listed on any part of the MalaysiaTraining.net website.
        • All course content pages and company profile of the member will be removed from search engines, including but not limited to Google and Bing.
        • All pending service requests related to web content will be on-hold. Service requests that are subject to time restriction may be overdue and cancelled due to late payment settlement.
        • Member's account will be terminated in SEVEN (7) days if the requirements to unsuspend the account have not been met.
      3. Requirements to Unsuspend the Account

        Members who have their account suspended are required to pay for the following in SEVEN (7) DAYS or else their account will be terminated:

        • RM50.00 processing fee that will not be included as part of the credit balance.
        • The prescribed Minimum Top-up Payment Amount.
        • The most recent outstanding amount stated in the latest Account Suspension Alert.
        • A minimum of RM300.00 deposit as credit limit (for members who have yet to upgrade their account to credit-limit-based).

        All payments made are required to follow the payment terms as stated in Section 5.0 - Payments. Any violation to the said payment terms may lead to the failure of account un-suspension and eventually lead to account termination. Payment received for unsuspending of account requires a minimum of THIRTY (30) days to the maximum of THIRTY FIVE (35) days (including weekends and public holidays) for the account to be unsuspended.

    2. Account Termination. The following describes the scenarios and conditions that will cause an account termination and its respective effects:
      1. Conditions for Account Termination

        • Both parties, namely I'MTP Member and OTK Web Solutions, have the rights to call for account termination by giving 24-hour written notice.
        • Members with credit limit can request for an automatic account termination when their credit limit has been fully utilized without any refund. They can also request for an automatic account termination upon RM0.00 credit balance by providing appropriate banking information for the refund of deposit (see Section 5.7 - Refund).
        • Members without credit limit can request for an automatic account termination upon RM0.00 credit balance without any refund.
        • No appropriate settlement has been made by the member in SEVEN (7) days after the account suspension.
      2. Effects of Account Termination

        • All course content pages and company profile of the member will be deleted and no longer be listed on any part of the MalaysiaTraining.net website.
        • All course content pages and company profile of the member will be removed from search engines, including but not limited to Google and Bing.
        • Any previously granted OTK related web application access rights will be revoked. The member will not be able to logon to I'MTP Service Centre. OTK will not responsible for any loss of personal data or information upon account termination.
  12. Accountability & Responsibility. Subscribers are accountable and responsible to their own deals and offers committed to their customers and the information submitted by them for publishing on any OTK related websites or social networks. OTK held no accountability and responsibility to any losses, discrepancies, disputes, and/or legal issues caused by any business and/or financial transactions between the subscribers and the customers that they are engaging with. I'MTP may be using third party tools, components, and applications, including but not limited to Google Blogger, Google Apps, Facebook and JotForm, to serve the subscribers. OTK will not responsible for any data loss and/or security issues caused by these third party products and services. When using any of the online services provided by OTK, subscribers are also bound by these third parties’ terms and conditions.

  13. Change of Terms & Conditions. I'MTP terms and conditions may subject to change from time to time without giving any prior notice to the subscribers. However, certain change of service methods and improvements, which may or may not affect the terms and conditions, may be conveyed to the subscribers through e-mail notifications, newsletters, blog, social networks, and/or MalaysiaTraining.net website. Subscribers are free to choose whether to continue their subscription on I'MTP services whenever there is a change on I'MTP terms and conditions. The change of I'MTP terms and conditions can be noticeable through its revision number. It is also available for viewing and download through the MalaysiaTraining.net website.

  14. Warranty Disclaimers. THE SERVICE, CONTENT, AND SITE ARE PROVIDED ON AN “AS IS” BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. SOME STATES DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

  15. Limitation of Liability. In no event shall OTK Web Solutions or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption,) arising out of the use or inability to use the materials on OTK Web Solutions's Internet site, even if OTK Web Solutions or a OTK Web Solutions authorized representative has been notified orally or in writing of the possibility of such damage. Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.
