Introduction

This programme shows how to handle cases of misconduct and indiscipline by employees and take 'natural justice' and legal disciplinary action including a domestic inquiry to prevent cases going to the Industrial Court.

Participants will benefit from an assessment of the stringent requirements set by the Industrial Court through case law. Participants will also receive samples of various documents.

Course Objectives

At the end of the programme, participants should be able to:

  • Identify minor and major misconduct
  • Understand how rules play an important part in domestic inquiry and taking disciplinary action
  • Understand how a minor misconduct can become a major one
  • Write appropriate 'disciplinary' letters
  • Conduct a professional Domestic Inquiry
  • Ask appropriate questions at the domestic inquiry
  • Write professional minutes of domestic inquiry
  • Decide on the proper penalty for the indiscipline

  • Delivering cautions and drafting show-cause and DI Letters
  • Constituting the DI board
  • DI proceedings

Morning Session

  • Decision making in misconduct and DI
  • Roles of the Industrial Relations Department and the Industrial Court
  • Major case-study
  • Case laws and statutes

Afternoon Session

  • Avoiding pitfalls in handling misconduct, DI and dismissals
  • Constructive dismissal
  • Workshop on handling misconduct and DI
