Ignorance of the Tenancy and Leasing laws is not a Privilege. It is a Misfortune.

Today’s business climate is challenging. The Ringgit is weaker and the economy is tough. We must seek out the opportunities to strengthen the management of our lease agreements/ contracts to avoid any legal issues. The ability to draft and amend lease agreements/ contracts is an indispensable skill that few business people are trained in. The misconception is that the company’s legal counsel or external counsel will handle all “legal” matters- yet, it is often in house teams who themselves negotiate and then draft commercial terms which eventually form the basis for legal rights and obligations on contracts and agreements. This practical 2- day course deals with the challenges, practical and legal aspects of landlord and tenant obligations within Landlord and Tenant Law and in accordance with the Tenancy/ Lease Agreements. Who is a reasonable landlord or tenant? The “reasonable man test” will be explained. It will also provide guidance on how to interpret and understand the meaning of clauses found in lease agreements. Many real life case-studies will be presented to highlight the pitfalls and challenges in managing tenancy and leasing agreements.

Samples of a commercial lease contract will be provided; with a walk-through explanation of a clause-byclause analysis.

This course will highlight common problems in leases & tenancies and how to tackle and manage them. Drafting techniques & strategies will be shared. There will be sharing of best practices on what particular terms & conditions should be negotiated in your lease agreements. Get a solid lease or tenancy agreement for better protection.

The Interest-Based Negotiation strategies will be taught thoroughly and applied into your tenancies/ leases negotiations.

The various methods for conflict resolution including mini-trials, mediation and arbitration will also be discussed to resolve tenancy disputes effectively and promptly. There is an interesting role-play exercise on mediation to enhance learning to resolve landlord and tenant disputes effectively. Participants will learn how to effectively defuse and resolve a “live” conflict arising from lease & tenancy agreements dispute through a realistic role-play and put their drafting skills to the test. There will be quizzes, case studies, role plays and class discussions for participants to practise their new-found knowledge. You do not need to have prior legal knowledge to benefit from this practical course.
